\n\tThis Agreement is between

\n\t(hereinafter 'the Licensor')\n<\/p>\n
\n\tand the Licensee whose information is provided in the form below
\n\t(hereinafter 'the Licensee')\n<\/p>\n
\n\t1. Subject
\n\tThe subject of this agreement is the non-commercial access and usage, including reproduction whole or in part, of digital spatial data through the Licensor by the Licensee for the purposes of developing projects to submit to the 3D Geospatial Geneva Showcase.\n<\/p>\n
\n\tThis agreement specifies the terms and conditions for use of the système d'information du territoire à Genève (SITG)'s geodata. By submitting this request for the data set, the Licensee agrees to comply with and be bound by the following terms and conditions of use. If you do not accept these terms and conditions, use is not authorized.\n<\/p>\n
\n\t2. Research Project and License Grant \n\tProject Description: The 3D Geospatial Geneva Showcase invites developers using advanced mobile technology in the city of Geneva to illustrate current state-of-the-art for in-situ capture, analysis and visualization of geospatial and geospatially-referenced data based on 3D and 2D data sets and to showcase the projects during a public in Geneva with smartphones and tablets during an event on June 11, 2014.\n<\/p>\n \n\tExpected Results: Mobile 3D data capture and visualization with high accuracy and low latency.\n<\/p>\n \n\t3. Data layers and parameters \n\t4. Terms of Use \n\tb) Without limiting the generality of 4a) above, any use of the data or parts thereof, either wholly or in derived form, for other purposes than those set out in point 2 above, are prohibited under the terms of this agreement. Any other such use, or reproduction of the data must be the subject of a new\/separate agreement between the parties.\n<\/p>\n \n\tc) All graphical and electronic products that use data provided above must bear the following copyright notice: © 2014 SITG\n<\/p>\n \n\td) There will be no charge for data processing and data sharing within and amongst the research project partners.\n<\/p>\n \n\te) This agreement may be terminated by either party, on one month's notice, but shall in any case terminate no later than June 11, 2015. Extensions may be requested from the SITG via the Showcase.\n<\/p>\n \n\t5. Final Provisions \n\tb) The Licensee in this agreement shall retain all rights to their own projects and in no way compromise their ability to modify or commercialize their projects.<\/span>\n<\/p>\n \n\tc) The Licensee in this agreement shall enforce the terms and conditions thereof with regard to their employees.\n<\/p>\n \n\td) The Licensor shall have no liability for the accuracy of the spatial data provided under this agreement and the Licensee agrees to save harmless the Licensor for any actions or responsibilities relating to the accuracy of the spatial data.\n<\/p>\n \n\te) The Licensor and Licensee agree that any litigation with regard to this matter shall be brought in the Canton of Geneva.\n<\/p>\n \n\tComplete the required fields and press Submit button below to indicate that you agree to the above terms and conditions and which data sets you wish to use:\n<\/p>\n \n\t
\n\tIn consideration for the participation of the SITG serving in the role of an 3D Geospatial Geneva Showcase<\/span> Partner, the licensor shall grant, free of charge, a non-exclusive license for non-commercial and not-for-profit use of the below listed spatial data of the city of Geneva solely for the activities set out in the 3D Geospatial Geneva Showcase<\/span>.\n<\/p>\n
\n\tUnder this license, the Licensor shall provide the Licensee the geodata in the coordinate system CH-LV03, as indicated in the request form below.\n<\/p>\n
\n\ta) Other than the rights accorded under this license and only for the purpose and duration set out herein, all rights regarding access, use and reproduction shall remain with the Licensor.\n<\/p>\n
\n\ta) The interpretation and enforcement of this agreement shall be governed by the federal law and the cantonal law of Geneva, if applicable, for the use of geodata and the enforcement of copyright.\n<\/p>\n
